The conference on Human Rights and Access to Justice will concentrate on three major themes namely Women’s Rights as Human Rights, Child Rights & the Law, Access to Justice & Human Rights, and Criminal Justice System and Human Rights. Women’s rights of health, education, political participation, and economic well-being are human rights and the Beijing Declaration affirmed that the protection of these fundamental rights is the basic responsibility of State parties. Gender equality and freedom from discrimination have been recognized by almost all Human Rights Covenants. This unequivocal recognition of Women’s Rights sits in stark contrast with their widespread violations throughout the world. The intersectionality of gender with caste and disability makes the realization of rights even more difficult for women of marginalized communities and those with disabilities.
Children’s Rights have been defined under the Convention on Rights of the Child. The interpretation of these rights has been varied in different contexts and jurisdictions. The lack of control and vulnerability of children makes a study of these rights compelling and necessary. It is also important to understand the working of the framework created for the protection of these rights in different jurisdictions.
The term access to justice is variously construed, from merely the aggrieved individual’s formal right to defend to an equal right of having recourse to an affordable, quick, satisfactory settlement of disputes from a credible forum. Today, access to justice can well be categorized between formal and informal modes. The formal mode includes ordinary adjudication of the dispute based on substantive and procedural laws. Informal access to justice on the other hand includes modes like ADR, Lok Adalats, Nyaya Panchayats, etc. which are not bound to follow code of civil procedure or code of criminal procedure and are only guided by principles of natural justice.
These issues are, undeniably of great importance in our society today. The aim of this conference is to bring together national and international researchers, academicians, and other industry stakeholders on one unified platform for brainstorming on these issues and to further contribute to the academic discourse and literature on this subject. A detailed brochure of the conference shall be sent to all registered participants.
