Moot Proposition: AI, Creativity, and Legal Personhood

The moot problem revolves around Aurelia Dynamics Pvt. Ltd., a Bengaluru-based AI research company, and its autonomous AI system FALCON-X, which allegedly generated:

  • A high-efficiency aerospace turbine-cooling duct design
  • A 900-line optimisation algorithm
  • A 4K digital artwork titled “Skyfire Descent”, which won first place at the Asia Digital Design Expo

Aurelia claimed independent AI authorship and inventorship, filing patent and copyright applications naming FALCON-X as co-inventor/co-author. These filings were rejected by the Controller General of Patents, Designs & Trade Marks (CGPDTM) on grounds that only natural persons can hold such rights, and that AI inventorship poses risks of data infringement .

The dispute further escalates when Stratos AeroDesign Ltd., a Hyderabad-based aerospace company, alleges that FALCON-X was trained on illegally scraped proprietary datasets, causing substantial economic harm. The matter is presently before the Commercial Division of the Delhi High Court, raising complex questions of:

  • AI inventorship and authorship
  • Copyright infringement without registration
  • Jurisdictional validity of administrative actions
  • Interim and ex-parte injunctions
  • Cross-territorial patent office authority

Participants are required to argue both sides within a single consolidated suit.
