Concept Note

  • The doctrine has traditionally looked at the post-adjudicative phase from the standpoint of the creditor State and the enforcement mechanisms available to that State in order to figure out how to get the opposing party to the dispute to comply with an international judgement. For decades, a large portion of the post-adjudicative phase in international proceedings involving a State as a defendant remained largely unexplored.
  • The goal of the webinar is to propose a shift in perspective and provide a complement to the typical post-adjudicative phase analysis centred on the enforcement of foreign judgments, decisions, and awards.
  • The recommended perspective is to begin the analysis with the debtor State, which is obligated to implement a decision, i.e., the State that did not prevail in the proceedings and has responsibilities ‘to do’ or’ refrain from’ defined in the international award, decision, or judgement:
  • What are the legal principles that govern the post-judgment period?
  • What are the legal obstacles/issues that governments have in implementing international duties emanating from an international award, decision, or judgement in their domestic order?

Relevant Speaker

  • The practise of Dr. Affef Ben Mansour concentrates on Public International Law, European Law, International Investment Arbitration, and Commercial Arbitration. Dr. Mansour is a member of the ICC International Court of Arbitration and serves as an arbitrator (Tunisia).
  • She has also worked as a teaching researcher at Paris Ouest Nanterre La Defense University, where she earned a Doctorate in Public International Law with honours in 2009 and a DEA in Law of International and European Economic Relations with honours in 2000.
  • Dr Ben Mansour continues her research and teaching activities as an Associate Researcher of the CEDIN (Public International Law Center of Paris Ouest Nanterre La Defense University) and a member of the French Society of International Law and the French Branch of the International Law Association. She published her thesis on The Implementation of International Judgments and Awards of International Tribunals in 2011
  • She also routinely writes in the fields of public international law and European law, as well as giving talks on a variety of themes in public international law, European law, and international arbitration. Dr. Ben Mansour has been named to the ICC Task Force on “Addressing Corruption Issues in International Arbitration.”
  • Since June 2018, she has also served on the Arbitral Women Board of Directors. French (native), Arabic, and English are her working languages. She can also read and understand Spanish and Italian texts. Dr. Ben Mansour is a Tunisian-Frenchman.
