About the Conference

“Right to Privacy is a fundamental right, it is intrinsic to right to life: Supreme Court.”

The NorthCap University was founded in 1996, to promote excellence in Technical and Management education by Educate India Society, registered under the Registration of Societies Act of 1860.

The University started providing the courses on law from 2010. The Law School offers undergraduate and postgraduate Law programs.

The Centre of Post-Graduate Legal Studies (CPGLS) at Law School, The NorthCap University, operates from the former Human Rights Department, which was inaugurated by Hon’ble Justice P.N. Bhagwati, former Chief Justice of India in 10th January 2011.

With the introduction of one year LLM by the University Grants Commission, in 2013 the Human Rights Department was remodeled as CPGLS to offer the new one year LLM course with multiple specializations.

The Vision of NCU Law School is to be ranked Numero Uno amongst the premier Law Schools in India.

The premise of our approach to Post-graduate legal education is to provide a competency for our Post-Graduate students to practice law in a competitive global level, irrespective of their initial level of exposure to law.

We have designed the curriculum to cater our students to the normative and professional challenges globalization entails and to equip them with the relevant tools to enable them to approach the law in a more encompassing, universally-aware manner.

Also, the Centre is constantly keeping consonance with the latest developments in law so as to abreast the curriculum with the contemporary world.

On 24th August, 2017 a nine-judge bench of the Supreme Court has ruled that Indians enjoy a fundamental right to privacy that it is intrinsic to life and liberty and thus comes under Article 21 of the Indian constitution.

In its 547-page judgment privacy was declared to be a fundamental right, the Supreme Court has overruled verdicts given in the M.P. Sharma case in 1958 and the Kharak Singh case in 1961, both of which said that the right to privacy is not protected under the Indian constitution.

Concerns of privacy arise when the state seeks to intrude into the body of subjects. Corporeal punishments were not unknown to India, their abolition is of a recent vintage. Forced feeding of certain persons by the state raises concerns of privacy.

The growth and development of technology has created new instruments for the possible invasion of privacy by the State, including through surveillance, profiling and data collection and processing.

Privacy is a limit on government power, as well as the power of private sector companies as if the individual permits someone to enter the house, it does not mean that others can enter the house.

Personal data is used to make very important decisions in our lives. Personal data can be used to affect our reputations; and it can be used to influence our decisions and shape our behavior.

It can be used as a tool to exercise control over us. And in the wrong hands, personal data can be used to cause us great harm. We organized this conference to discuss the different aspects of right to privacy.

Note: Seminars and Conferences at NCU Law School are not intended to provide a stage for discussing overview/introduction/fundamentals of law.

Issues discussed herein are to be treated and addressed as ‘Research Topics’ leading to intellectual discussion and debate.

Papers are required to evidence the author’s sound understanding of Right of Privacy.

Hence, papers whose contents are substantially generic in nature are likely to be summarily rejected during the course of reviewing.

Call for Papers

Research papers are invited from Scholars, Researchers, Practitioners, Academicians and Students on issues related to the above theme.

Authors of selected papers will be given an opportunity to present their papers in the conference.

Joint authorship is permitted, subject to a maximum of one co-author.

After acceptance of the abstract, the full paper should also be sent to the same email-id.
